The proposed measure would also confirm the property’s General Plan land use designation is General The purpose of the proposed measure is to change the zoning on the property from its current zoning classification of Auto Center/Auto Center Overlay (“AC/AC-O”) to Commercial General/Auto Center Overlay (“CG/AC-O”). The property that is the subject of the proposed initiative measure is the site of the former Nissan automobile dealership located at 29901 Santa Margarita Parkway in the City of Rancho Santa Margarita and is approximately 4.75-acres. Measure Z will change the zoning on the property located at 29901 Santa Margarita Parkway in the City of Rancho Santa Margarita. Measure Z is an initiative submitted to the voters which was placed on the ballot by a petition signed by the requisite number of voters. The following impartial analysis of Measure Z was prepared by the office of the city attorney: “ Initiative to Restore Commercial General (CG) Zoning for The Former Nissan Automobile Dealership Property. The official initiative title appeared as: “ Remember we bought this from NMAC Bank (Nissan Motor Acceptance Corp.), as they were in a terrible situation that the City forced onto them." Banks are not interested in underwriting collateral that has no other use beside a dealership. Dealership businesses carry heavy loans for their capital intensive operations/real estate/ inventory. Yes on Z will only help a dealership come to this site. He said, "Toyota would definitely be our first choice. ![]() ![]() Joe Daichendt, owner of Theory R, insisted that his company had been working with Toyota from the beginning and that Measure Z would facilitate a deal with Toyota. They cited the proposed Toyota deal, claiming that to have the land zoned for Commercial General would have made the land more valuable, giving banks a greater interest in backing the development and improvement of the land. Theory R and Measure Z supporters responded by saying that, while a fourth dealer would never start up in the city, Measure Z would have actually made it easier to sell the land to an existing dealer. Critics pointed to the two substantial offers Theory R had received as evidence. Opponents of Measure Z claimed that a dealer could be found and that Theory R is not appropriately open to facilitating such a deal, and was instead looking to use the property for other reasons. The only business we’ve found to operate here is U-Haul who uses a small portion of the site and their rent doesn’t even cover the property taxes. A representative of Theory R said, with regard to finding a fourth auto dealer to occupy the property, said, "We’ve talked to every manufacture in the US, hired the #1 auto consultant in Orange County, spent countless money on advertising the property and called every major dealership on the west coast with no luck. Theory R insisted, however, that an actual fourth dealership is impossible to find. Theory R had received an offer for the land from a company with connections to a neighboring Honda dealership, and another from the city's Toyota dealership, which was interested in relocating to the Santa Margarita Parkway property. Theory R insisted that a fourth dealership would be impossible in the city and as such the land should be rezoned. Supporters of Measure Z claimed the auto industry is already saturated in the city, with three dealerships inside city limits, and larger ones nearby, but outside city boundaries. The debate around Measure Z largely focused on the possibility of operating an auto dealership on the property in question. The Rancho Santa Margarita (RSM) City Council rezoned the land from Commercial General to Auto Center in October of 2010. Without Measure Z, the land in question would continue to be zoned specifically for an Auto Center (AC). If approved, Measure Z, which was proposed through a successful citizen initiative, would have restored Commercial General (CG) zoning to 4.75 acres at 29901 Santa Margarita Parkway, which was previously the location of the Nissan car dealership.
